EXPERIENCE AND CREDENTIALS
Brian started his legal practice in the Corporate & Commercial Department of the firm and he has advised on corporate exercises ranging from mergers and acquisitions to IPOs. He had also advised on timber concession arrangement in Angola and negotiated agreements in Ho Chi Minh, Dubai, and Paris. His experience in the corporate division served as a platform for him to leap into corporate litigation.
Brian then shifted his area of practice to litigation where he was involved in corporate litigation, judicial review, arbitration, banking litigation, matters involving administrative law, employment, industrial relations and tortious matters including conspiracy to defraud and breach of trust and confidence. He draws his litigation experience after having appeared in the Industrial Court, High Court, Court of Appeal and the Federal Court.
His clientele includes multi-national corporations and public limited companies. He has conducted an arbitration proceeding against the state government and handled cross-border disputes in Hong Kong, British Virgin Island, Papua New Guinea and Malaysia as the instructing solicitor.
Recently, Brian has assisted his client in an investigation by Malaysian Competition Commission (MyCC) on purported breach of the Competition Act 2010, represented his client in a disciplinary hearing conducted by the Malaysian Medical Council and sat as a member in the Committee of Inspection of a company under liquidation.
Brian sits in the Disciplinary Committee of the Advocate & Solicitors’ Disciplinary Board and is a qualified mediator with Malaysian Mediator Centre. Further, he sits as a President of the Strata Management Tribunal under the purview and jurisdiction of the Ministry of Housing and Local Government.
He has given talks in relation to Competition Law to clients and has chaired seminars and moderated legal forums organised by professional bodies. Brian also appeared regularly as panel judge in the national moot competition organised by LawAsia and the Bar Council.
Brian ML Foong is a graduate of University of London with an Honours degree in law and later obtained his Certificate of Legal Practice (CLP).
Brian was admitted as an advocate & solicitor of the High Court in Malaya in 2001.
Prior to joining legal practice, he was a law lecturer in English Law of Contract and Tort.
